Many people believe that all lawyers have the same training and skills, or that because an attorney advertises in a particular area, he has experience in that area. This could not be further from the truth. Unfortunately, it is very difficult for a prospective client to effectively evaluate the competency of an attorney before hiring them. As a former prosecutor, I handled thousands of cases and watched my many fellow prosecutors handle cases in the largest county in Virginia. I was always amazed at the number of attorneys who knew little or nothing about DWI or how to try a case, but who took case after case, charged incredible fees, and simply walked into court and pleaded their clients guilty without putting up a fight. Yet, these lawyers continue to get clients – not because they are good attorneys, but because they have a good marketing machine. Their clients are none the wiser because they only see what happens in their case and, therefore, have no basis for comparison. As a prosecutor, however, you see what happens in every case. While some attorneys are giving up without a fight, deals are being struck with the qualified and skilled attorneys on more favorable terms, or those attorneys are taking their cases to trial and winning. Who you hire as an attorney will be the single greatest factor that will decide the outcome of your legal situation. The reality is that all lawyers do not have the same training and simply being admitted to the bar in a particular state does not mean that an attorney is qualified to handle any case.
